A Very Catchy Title

This is an sample from the National Association of Homebuilders’ (NAHB) new campaign to promote homebuying, as reported in the Inman Blog. I like the message, and I love the title. The only problem is that “It’s Your Move” is our registered service mark in California. See the little “SM” thingy on our website banner?

Now, if you are in Idaho, have at it. It seems some Florida company who provides ancillary services to real estate agents has already snagged the national service mark for “It’s Your Move”. In California, however, we have registered the phrase. We send out almost weekly cease and desist letters to competitors in our area trying to borrow our very catchy (if I do say so myself) logo/tagline. It is not that I am a grump. It’s just that we have spent years not to mention a boatload of money developing our brand. Should this one concern me? Any agents or brokers out there, I would be interested in your opinion. Maybe we will just change our line to “There’s always something to howl about“.

    Trying to trademark commonly used language, doesn’t make much sense to me. Are you going to go to chess tournaments and slap everyone who says “It’s Your Move” LOL.

    Barb Schwarz trademarked the word “Staging”, but we all have to use that word, don’t we? Can she really stop every agent in the country from talking about staging a home, if we don’t use an ASP “Stager”?

    I don’t think anyone can really, practically speaking, OWN the word staging or the words “It’s Your Move”. but then, as they say, there’s always something to complain or howl about :-) if that’s worth it to ya.

    So is Greg always howling about someting, to brand his slogan? Or did the slogan come first, because he was always a howler? Chicken or the egg?

    Thanks, Ardell. I’ll lighten up where NAHB is concerned, and I understand your point in a way, but I don’t have the strong sense that the fellows at the chess match are attempting to practice real estate. I think you would agree, however, that when other Arizona agents start marketing with Greg’s line or San Diego agents with mine, it could indeed cause “confusion in the marketplace”, which is the litmus test for disallowing similar service marks and the purpose of registering them to begin with.

    Regarding Greg, I suspect he was born howling. :)
